In plain language: Play and enjoy the game. Don't cheat, hack, or abuse it. Purchases are handled by Apple. The game is provided "as is," and Florida law governs these terms.

These Terms of Use ("Terms") govern your use of the mobile game Pixel Park Rescue (the "App"), published by Cacele Digital, LLC, a Florida limited liability company located in St. Augustine, Florida ("Cacele," "we," "our," "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your own personal, non-commercial entertainment, subject to these Terms and to the Apple Media Services Terms and Conditions.

2. What you can't do

Reverse-engineer, decompile, or attempt to extract the source code or assets of the App, except where this restriction is prohibited by law.
Cheat, use unauthorized third-party software, exploit bugs, or tamper with saves, purchases, the economy, or advertising.
Distribute, resell, rent, or sublicense the App or its assets.
Use Cacele branding, logos, artwork, or the game's name to imply affiliation or endorsement without our written permission.
Use the App to break the law or infringe anyone's rights.

3. Virtual items and in-app purchases

The App offers optional in-app purchases and virtual items (such as gems, resource packs, boosters, and an ad-free upgrade). Virtual items and in-game currency have no real-world value, cannot be exchanged for cash, and are licensed to you, not sold. All purchases are processed by Apple through the App Store; we do not process payments directly. Refund requests are handled by Apple at reportaproblem.apple.com. Non-consumable purchases can be restored with the Restore Purchases button; consumable items are used when granted and are not restorable.

4. Advertising

The App is free to play and supported by advertising provided through Google AdMob, along with optional in-app purchases. Some ads are optional and rewarded. You can remove banner and interstitial ads with the one-time Remove Ads upgrade. See our Privacy Policy for how ad data is handled.

5. Your content and progress

Game progress is stored locally on your device and is not tied to an account. We are not responsible for progress lost due to deleting the App, changing or resetting a device, or device failure.

6. Updates and availability

We may update, change, or discontinue the App or any feature at any time. We aim to keep the App working well but do not guarantee that it will be uninterrupted or error-free.

7. No warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Cacele Digital, LLC and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App, even if advised such damages were possible. Our total aggregate liability for any claim related to your use of the App is capped at the greater of the amount you paid us for the App in the past twelve months or one hundred US dollars ($100).

9. Indemnification

You agree to indemnify and hold Cacele harmless from any claim or demand arising from your misuse of the App, your violation of these Terms, or your infringement of any third-party rights.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in St. Johns County, Florida, and you consent to that jurisdiction. If any portion of these Terms is found unenforceable, the rest remains in effect.

11. Apple

These Terms are between you and Cacele, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any App maintenance, support, or warranty claims are our responsibility, not Apple's, to the extent required by the Apple Media Services Terms and Conditions.

12. Changes to these Terms

We may update these Terms from time to time. The current version is always at this URL with a "Last updated" date. Continued use of the App after changes means you accept the new version.
